These d ACCOUNT Terms of Use (the “Terms”) set forth the terms and conditions regarding the use of (i) a “DOCOMO d ACCOUNT,” which is issued by NTT DOCOMO, INC. (“DOCOMO”) to a person who has concluded a line subscription contract based on the contract agreement separately provided by DOCOMO ("Line Subscription Contract") in its personal name (each person who has concluded a Line Subscription Contract is a “Line Subscriber”) and (ii) a “Carrier-Free d ACCOUNT,” which is issued by DOCOMO to a person who has not concluded a Line Subscription Contract (except for Carrier-Free Business d ACCOUNTs provided in the Business d ACCOUNT terms of use (provided in Article 3),” and the Terms shall apply to persons to whom DOCOMO d ACCOUNTs and/or Carrier-Free d ACCOUNTs (collectively “d ACCOUNTs”) have been issued (each such person is a Customer or you). If you do not agree to the Terms, you may not use d ACCOUNTs.

Chapter 1 Use of d ACCOUNT

Article 1 Use of d ACCOUNT

  1. d ACCOUNTs are used to identify Customers when they apply for or use services provided by DOCOMO or by companies who provide applications or websites that support authentication using d ACCOUNTs (such services are “Compliant Services” and companies who provide Compliant Services other than those provided by DOCOMO are “Compliant Service Providers”).
  2. Compliant Services provided by DOCOMO shall be as set forth on DOCOMO’s websites and other sites presenting information about d ACCOUNTs and receiving d ACCOUNTs applications (among such websites, those separately designated by DOCOMO as the sites intended for d ACCOUNT-related applications and settings are "Dedicated Sites").
  3. DOCOMO and Compliant Service Providers authenticate Customers with authentication methods using d ACCOUNTs associated with respective Compliant Services as separately designated by DOCOMO and Compliant Service Providers (such authentication methods include those based on the d ACCOUNT IDs and passwords entered, biometrics functions as provided in Article 5, and sometimes combinations of any of the above and other additional elements).
  4. If authentication using your d ACCOUNT is performed as provided in Article 1.3 on the d ACCOUNT authentication screen designated by a Compliant Service, any information entered on the screen shall be deemed by DOCOMO and the Compliant Service Provider to have been entered by you, even if it was entered by a third party, and any action performed following authentication using your d ACCOUNT shall be deemed by DOCOMO and the Compliant Service Provider to have been performed by you, except for cases arising out of intentional acts or negligence on the part of DOCOMO.
  5. The type and details of Compliant Services available to you varies depending on the type of your d ACCOUNT and the provision policy of each Compliant Service Provider. If you use a DOCOMO d ACCOUNT, you are subject to further variations depending on the type of your Line Subscription Contract and your contract status. DOCOMO may modify any part of Compliant Services (including specifications thereof) or suspend or discontinue your use of Compliant Services without prior notice to you. As some Compliant Services are in principle available only to Line Subscribers (“Subscriber-Only Services”), you shall carefully check the availability of Compliant Services you wish to use before using your d ACCOUNT (a Line Subscriber may use a Carrier-Free d ACCOUNT but shall have no right to perform procedures as a Line Subscriber with a Carrier-Free d ACCOUNT). You shall use Compliant Services (including various applications thereof) at your own responsibility. For persons who are not residents of Japan, those under the age of 18 must obtain consent from a parent or other legal representative to use a d ACCOUNT, and those under the age of 13 are not permitted to use a d ACCOUNT.
  6. If you have performed member integration ("Member Integration") as provided in the d POINT Club Membership Rules (“d POINT Club Membership Rules”), you may perform procedures (only those separately specified by DOCOMO on the d POINT Club sites as provided in the d POINT Club Membership Rules) at “DOCOMO online shop” ("DOCOMO Online Shop”) or on the “ahamo Site” offered by DOCOMO (collectively “DOCOMO Online Shops”) for mobile phone numbers for all Line Subscription Contracts belonging to the “Integrated Contract Group” as provided in the d POINT Club Membership Rules by choosing a phone number of the Line Subscription Contract for which you wish to perform such procedure from the list of mobile phone numbers (all digits) of all Line Subscription Contracts belonging to the Integrated Contract Group, provided that you have already completed authentication by entering either (a) the ID and password (collectively the ID/Password) of your DOCOMO d ACCOUNT associated with any Line Subscription Contract belonging to the Integrated Contract Group (including the ID/Password of any Carrier-Free d ACCOUNT converted from a DOCOMO d ACCOUNT associated with the Line Subscription Contract that used to belong to the Integrated Contract Group but has been cancelled or terminated by DOCOMO pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract) or (b) your Network PIN associated with the line you are using to access DOCOMO Online Shops (the line shall be limited to the one associated with any of the Line Subscription Contracts belonging to the Integrated Contract Group).
  7. Regarding the d-Card service provided pursuant to the “d-Card Terms of Use (Membership Terms)” (the “d-Card Terms of Use”) as separately provided by DOCOMO, IP communication network service provided pursuant to the “IP Network Service Contract Agreement” (“IP Communication Network Agreement”) as separately provided by DOCOMO, and electricity brokerage service offered pursuant to the “DOCOMO Denki Supply Contract Agreement” (“DOCOMO Denki Agreement”) as separately provided by DOCOMO, if you have a Carrier-Free d ACCOUNT for which your identity has been already verified with official identification documents pursuant to the procedure as separately provided by DOCOMO (“Verified Carrier-Free d ACCOUNT,” and such verification procedure shall include your expressed consent to use authentication using your d ACCOUNT to verify your identity) and if you perform authentication using your Verified Carrier-Free d ACCOUNT, you may use the Verified Carrier-Free d ACCOUNT for using the following services: d-Card service provided pursuant to the “d-Card Terms of Use (Membership Terms)” (the “d-Card Terms of Use”) as separately provided by DOCOMO, IP communication network service provided pursuant to the “IP Network Service Contract Agreement” (“IP Communication Network Agreement”) as separately provided by DOCOMO, and electricity brokerage service offered pursuant to the “DOCOMO Denki Supply Contract Agreement” (“DOCOMO Denki Agreement”) as separately provided by DOCOMO, provided that the Verified Carrier-Free d ACCOUNT may be used only for those offered pursuant to the contracts concluded in your name among the following services: d-Card Contracts concluded pursuant to the d-Card Terms of Use (“d-Card Contracts”), IP Communication Network Services Contracts concluded pursuant to the IP Communication Network Agreement (“DOCOMO Hikari Contracts”), demand/supply contracts concluded pursuant to the DOCOMO Denki Agreement (“DOCOMO Denki Contracts,” and d-Card Contracts, DOCOMO Hikari Contracts, and DOCOMO Denki Contracts concluded in your name are collectively “DOCOMO-Specified Contracts”). Note that the Verified Carrier-Free d ACCOUNT that you have used to verify your identity as the person who concluded such DOCOMO-Specified Contracts for using services based on DOCOMO-Specified Contracts pursuant to this Article 1.7 shall also be used to verify your identity in applying for or using other Compliant Services (except for services based on d-Card Contracts, DOCOMO Hikari Contracts or DOCOMO Denki Contracts which are not DOCOMO-Specified Contracts) as the person who has concluded each relevant DOCOMO-Specified Contract pursuant to Article 1.4.
  8. With regard to authentication using d ACCOUNTs, if there is any discrepancy between the Terms and the terms of Compliant Services, the terms of such Compliant Services shall prevail with regard to the use of the respective Compliant Services, except as otherwise provided.
  9. With some Compliant Services, if you log in by entering your d ACCOUNT’s ID/Password on the d ACCOUNT authentication screen provided by DOCOMO, the authentication status will be maintained and you may continue to use such Compliant Services without having to re-enter the d ACCOUNT ID/Password as long as the authenticated status is valid. The duration of the validity of d ACCOUNT’s ID/Password authentication status varies among sites. If you want to revert the status of d ACCOUNT’s ID/Password authentication from authenticated to unauthenticated, you may do so by deleting cookies from the browser settings. Regarding the terminals separately designated by DOCOMO, if you have set your d ACCOUNT ID/Password on the terminal in advance (such setting is the “d ACCOUNT Setting” and the application provided by DOCOMO for you to perform the d ACCOUNT Setting is the “d ACCOUNT Setting App”), you may skip the entry of the d ACCOUNT ID/Password that would otherwise be required each time for applications and sites associated with Compliant Services as separately designated by DOCOMO (such applications are “d ACCOUNT Setting Compliant Apps”), except in some cases. When you use the d ACCOUNT Setting App or sites from a terminal that has completed the d ACCOUNT Setting, you may skip the entry of the d ACCOUNT ID/Password that would otherwise be required each time. However, any action performed under such circumstances shall be deemed by DOCOMO to have been performed by you, even if such entry was performed by a third party, except for cases arising out of intentional acts or negligence on the part of DOCOMO. If your terminal on which the d ACCOUNT Setting has been completed is lost or stolen, you shall immediately perform a procedure to disable the d ACCOUNT Setting on the terminal from the site separately designated by DOCOMO.
  10. If you have performed Member Integration, and if you wish to perform the d ACCOUNT Setting on a terminal using the line associated with a Line Subscription Contract belonging to the Integrated Contract Group, you may do so by selecting a DOCOMO d ACCOUNT for which you wish to perform the d ACCOUNT Setting from the list of DOCOMO d ACCOUNTs (all digits) of all Line Subscription Contracts belonging to the Integrated Contract Group without having to perform authentication using the ID/Password of the DOCOMO d ACCOUNT associated with each Line Subscription Contract belonging to the Integrated Contract Group (including any Carrier-Free d ACCOUNT converted from a DOCOMO d ACCOUNT associated with the Line Subscription Contract that used to belong to the Integrated Contract Group but has been cancelled or terminated by DOCOMO pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract; the same shall apply hereinafter in this Article 1.10) or the Network PIN associated with the Line Subscription Contract used for the terminal on which the d ACCOUNT Setting is to be performed (both authentication methods mentioned above are collectively “This Authentication”) and by performing this Authentication to perform the d ACCOUNT Setting (you may also view the usage history of Compliant Services associated with the DOCOMO d ACCOUNT).
  11. During your use of sites and applications, you shall be careful about the login status in each site and application because the login status is sometimes different among (i) sites where the authenticated status is maintained after authentication using d ACCOUNT due to the function as specified in Article 1.9, (ii) applications or sites where authentication is performed by the d ACCOUNT Setting using the function specified in Articles 1.9 and 1.10, and (iii) applications or sites where authentication is performed with the use of methods other than those based on the d ACCOUNT ID/Password. If you have performed authentication using different d ACCOUNTs from the same terminal, the login status is sometimes different among such sites or applications depending on the d ACCOUNT used for authentication before such login.
  12. If you are using a DOCOMO d ACCOUNT, part of the d ACCOUNT ID is sometimes automatically displayed when you use a Compliant Service provided by DOCOMO via sp-mode, ahamo Internet connection service, irumo internet connection service, DOCOMO mini internet service or i-mode.
  13. When you use authentication using d ACCOUNT to log in or use a Compliant Service, you are sometimes required to enter a security code (which shall mean a security code with a period of validity; the same shall apply hereinafter) sent to you in a manner separately specified by DOCOMO.
  14. You shall prepare and use at your own responsibility and expense any items necessary for performing procedures related to the use of d ACCOUNTs and authentication using d ACCOUNT and for using Compliant Services, such as a mobile phone number, an email address, and communication environments including an internet connection specified by DOCOMO.

Article 2 Notification of Information

  1. If authentication using a DOCOMO d ACCOUNT is performed in a Compliant Service provided by a company other than DOCOMO, DOCOMO sometimes sends the following information via the internet to the Compliant Service Provider to identify the Customer using the Compliant Service or display sites suitable for the Customer based on the Customer's attributes or other information:
    1. DOCOMO OpenID, User ID, and i-mode ID (each ID consists of a combination of letters and numbers specific to DOCOMO’s subscription lines but is different from a subscriber identification number of FOMA, Xi service, or a 5G service or d ACCOUNT ID).
    2. Information on the status of specific service contracts (information on the presence/absence of contracts of services such as Lemino Premium and d-Magazine)
    3. Information on the device model you have registered on My DOCOMO or ahamo site
    4. Any other Information specified by DOCOMO for each Compliant Service
  2. If authentication using a Carrier-Free d ACCOUNT is performed in a Compliant Service provided by a company other than DOCOMO, DOCOMO sometimes sends to the Compliant Service Provider via the Internet the Open ID (a specific character string allocated by DOCOMO to each Carrier-Free d ACCOUNT and Compliant Service) and information specified by DOCOMO for each Carrier-Free d ACCOUNT and Compliant Service to identify the Carrier-Free d ACCOUNT for which the authentication is performed in the Compliant Service Provider.
  3. If authentication using a DOCOMO d ACCOUNT or a Carrier-Free d ACCOUNT is performed in a Compliant Service provided by a company other than DOCOMO, DOCOMO and the Compliant Service Provider sometimes share and jointly use the information specified by DOCOMO regarding each Compliant Service including the account identifier (an arbitrary identification number allocated by DOCOMO to each Customer’s subscription line or d ACCOUNT) pursuant to the details separately provided by DOCOMO.

Article 3 Application for Use of DOCOMO d ACCOUNT

  1. To use a DOCOMO d ACCOUNT, you shall make an application in advance in accordance with the procedures separately specified by DOCOMO. Note that an application for a DOCOMO d ACCOUNT shall be made for each Line Subscription Contract.
  2. If you are using a Carrier-Free d ACCOUNT, and if you have concluded a Line Subscription Contract (except for those concluded in the name of a corporation), you may convert your Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT through phone number registration as provided in Article 10.1.
  3. If you have a DOCOMO d ACCOUNT already issued (only if you have not chosen Course B ("Course B") from the 5G contract categories specified in the 5G Service Contract Agreement (a “Course B Line Subscriber”)), and if you change the category of your Line Subscription Contract to Course B, you will be deemed to have a DOCOMO d ACCOUNT associated with Course B (“DOCOMO d ACCOUNT (Course B)") upon completion of such category change in your Line Subscription Contract.
  4. If DOCOMO accepts your application for a DOCOMO d ACCOUNT made pursuant to Article 3.1, DOCOMO will issue an ID/Password for the DOCOMO d ACCOUNT according to your application method and the status of your Line Subscription Contract.
  5. DOCOMO may reject your application made pursuant to Article 3.1 if you fall under any of the following circumstances.
    1. Your application is found to contain false statements, errors, or omissions in the items registered or submitted at the time of the application.
    2. Your application is not made by a Line Subscriber (including cases where it is impossible to confirm that the application is made by the relevant Line Subscriber).
    3. The character string you have specified for your DOCOMO d ACCOUNT is the same as the one already issued as the ID of a DOCOMO d ACCOUNT or a DOCOMO Line Business d ACCOUNT (“DOCOMO Line Business d ACCOUNT”) set forth in the “terms and conditions of Business d ACCOUNT” (the “Business d ACCOUNT Terms”) separately provided by DOCOMO.
    4. The character string you have specified for your DOCOMO d ACCOUNT is the same as the one already issued as the ID of a Carrier-Free d ACCOUNT or a Carrier-Free Business d ACCOUNT (“Carrier-Free Business d ACCOUNT”) set forth in the Business d ACCOUNT Terms.
    5. Any of your DOCOMO d ACCOUNTs has been terminated due to any of the reasons set forth in Articles 11.2 and 11.3.
    6. Any other cases where DOCOMO determines that it is inappropriate to approve your use of a DOCOMO d ACCOUNT.
  6. Notwithstanding Article 3.2, in some cases it will be impossible to convert your Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT if you fall under any of the following circumstances:
    1. You had a Line Subscription Contract and wish to convert your Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT pursuant to Article 3.2, while your DOCOMO d ACCOUNT was terminated due to any circumstances set forth in Articles 11.2 and 11.3 before its conversion to the current Carrier-Free d ACCOUNT.
    2. You had a Line Subscription Contract and wish to convert your Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT pursuant to Article 3.2, while DOCOMO determines that the Line Subscriber of the Line Subscription Contract for which you wish to register a phone number is not the same person as the Line Subscriber of the Line Subscription Contract associated with the DOCOMO d ACCOUNT converted to the current Carrier-Free d ACCOUNT.
    3. You have been using any of the Compliant Services separately specified by DOCOMO with your Carrier-Free d ACCOUNT, and (i) the Line Subscription Contract for which you wish to register a phone number is not based on the FOMA Service Subscription Contract Agreement, Xi Service Subscription Contract Agreement, or the 5G Service Subscription Contract Agreement; (ii) you use any of the billing types or services separately specified by DOCOMO in the Line Subscription Contract; or (iii) you wish to continue to use such Compliant Services (only those separately specified by DOCOMO) you have used with the Carrier- Free d ACCOUNT.
    4. You have performed Member Integration and wish to convert your Carrier-Free d ACCOUNT (only if it does not belong to the Integrated Contract Group in which such Member Integration has been performed) to a DOCOMO d ACCOUNT through phone number registration as provided in Article 10.1 (only if the Line Subscription Contract for which you wish to register a phone number belongs to the Integrated Contract Group).
    5. You have performed Member Integration and wish to convert your Carrier-Free d ACCOUNT (only if it belongs to the Integrated Contract Group in which such Member Integration has been performed) to a DOCOMO d ACCOUNT through phone number registration as provided in Article 10.1 without performing the member separation procedure as provided in the d POINT Club Membership Rules.
    6. DOCOMO determines that it is inappropriate to approve the conversion to a DOCOMO d ACCOUNT.
    7. Any other cases separately specified by DOCOMO as those where the conversion to a DOCOMO d ACCOUNT is impossible.

Article 4 Application for Use of Carrier-Free d ACCOUNT

  1. To use a Carrier-Free d ACCOUNT, you shall apply for a Carrier-Free d ACCOUNT by entering or specifying the ID/Password you wish to use as your Carrier-Free d ACCOUNT ’s ID/Password, as well as your name and its reading (in katakana), date of birth, gender, and contact email address on the dedicated site or the site separately designated by DOCOMO, pursuant to the procedures separately provided by DOCOMO. Upon request by DOCOMO, you shall also enter or specify a contact mobile phone number when applying for a Carrier-Free d ACCOUNT.
  2. Upon application for the use of a Carrier-Free d ACCOUNT as provided in Article 4.1, you shall also join the "d POINT Club" ("d POINT Club") operated pursuant to the d POINT Club Membership Rules. After joining the d POINT Club, you may be asked to become a user (“d POINT User”) as separately provided in the d POINT Club Special Terms and Conditions (the "d POINT Club Special Terms ") by registering your information ("d Point User Information Registration," which shall include your expressed consent to the d POINT Club Special Terms) as provided in the d POINT Club Special Terms. Note that if docomo finds any difference between the information you entered or specified when applying for a Carrier-Free d ACCOUNT pursuant to Article 4.1 (“Carrier-Free d ACCOUNT Application Information") and the user information registered pursuant to the d POINT Club Special Terms ("d POINT User Information"), docomo will change your Carrier-Free d ACCOUNT Application Information to your d POINT User Information.
  3. Notwithstanding the foregoing, if you apply for a new Carrier-Free d ACCOUNT during the application procedure for a Course B contract, wishing to use such Carrier-Free d ACCOUNT as a DOCOMO d ACCOUNT (Course B) after the conclusion of the Course B contract pursuant to Article 10.1, you shall perform d POINT User Information Registration at the same time as joining the d POINT Club. Upon completion of your application procedure for the Course B contract, you shall be deemed by DOCOMO to have completed your application for the d POINT Club and d POINT User Information Registration. Note that if docomo finds any difference between the information you entered or specified such as your name when applying for a Carrier-Free d ACCOUNT pursuant to this Article 4.3 and the user information registered pursuant to the d POINT Club Special Terms, docomo will change your Carrier-Free d ACCOUNT Application Information to your d POINT User Information.
  4. If you use a Carrier-Free d ACCOUNT that does not fall under any of the following circumstances (an "Eligible Carrier-Free d ACCOUNT") and have modified your d-POINT User Information registered at the time of d POINT User Information Registration performed pursuant to Article 4.2, DOCOMO will change your Carrier-Free d ACCOUNT Application Information to the modified d POINT User Information.
    1. The Carrier-Free d ACCOUNT is an account converted from a DOCOMO d ACCOUNT associated with the Line Subscription Contract you had concluded pursuant to Article 9.
    2. The Carrier-Free d ACCOUNT is a Verified Carrier-Free d ACCOUNT that you use or have used to authenticate your identity as the person who concluded the DOCOMO-Specified Contracts for using services based on such DOCOMO- Specified Contracts pursuant to Article 1.7.
  5. If you have canceled your Line Subscription Contract, if DOCOMO has terminated your Line Subscription Contract pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract, or if your Line Subscription Contract has been transferred to another person, the DOCOMO d ACCOUNT will be automatically converted to a Carrier-Free d ACCOUNT pursuant to Article 9.1, and you may continue to use such Carrier-Free d ACCOUNT. However, the foregoing shall not apply to the cases where the person to whom the Line Subscription Contract is transferred (a “Transferee”) is a line user (a “Line User,” who is a person whose name has been reported to DOCOMO by the Line Subscriber as a customer who actually uses the line associated with the Line Subscription Contract in the manner specified by DOCOMO pursuant to the contract agreement under the Line Subscription Contract applicable until the transfer. For the purposes of this Article 4.5, such person shall be limited to a parent or a child of the Line Subscriber who concluded the Line Subscription Contract applicable until the transfer or any other person deemed to satisfy the conditions separately provided by DOCOMO). In this case, upon completion of the contract transfer procedure, the DOCOMO d ACCOUNT will be succeeded by the Transferee and may be used continuously. Regarding the DOCOMO d ACCOUNT succeeded by a Transferee due to the transfer of the Line Subscription Contract, such information as the name of the Customer specified at the time of application for the DOCOMO d ACCOUNT pursuant to Article 3.1 will be changed to the information of the Transferee associated with the Line Subscription Contract.
  6. Upon accepting your application for the use of a Carrier-Free d ACCOUNT made pursuant to Article 4.1, DOCOMO will send you an email or short message that contains a one-time key (a password with a validity period sent to an email address or mobile phone number you specify) in the manner separately specified by DOCOMO (such email or short message is a "One-time Key Notification Mail"). The issuance of the ID/Password of a Carrier-Free d ACCOUNT will be completed when you enter the one-time key shown in the One-time Key Notification Mail into the dedicated site.
  7. Notwithstanding the foregoing, in cases otherwise specified by DOCOMO, any One-time Key Notification Mail will not be sent, and the issuance of the ID/Password of a Carrier-Free d ACCOUNT will be completed when DOCOMO displays the completion of the application procedure on the dedicated site.
  8. DOCOMO may reject your application made pursuant to Article 4.1 if you fall under any of the following circumstances:
    1. The application is found to contain false statements, errors, or omissions in the items registered or submitted at the time of application.
    2. The email address you have specified for your Carrier-Free d ACCOUNT is the same as the one already issued as the ID of a Carrier-Free d ACCOUNT or a Carrier-Free Business d ACCOUNT.
    3. The email address you have specified for your Carrier-Free d ACCOUNT is the same as the one already issued as the ID of a DOCOMO d ACCOUNT or a DOCOMO Line Business d ACCOUNT.
    4. The mobile phone number you have specified as the contact phone number of your Carrier-Free d ACCOUNT is the one already registered as the contact phone number of a d ACCOUNT.
    5. The email address you wish to use as the ID of your DOCOMO Carrier-Free d ACCOUNT is the one associated with a Carrier-Free d ACCOUNT that was
    6. terminated for reasons set forth in Article 12.2 due to a violation of the Terms.
    7. Any other cases where DOCOMO determines that it is inappropriate to approve the use of a DOCOMO Carrier-Free d ACCOUNT.
  9. If you perform an application procedure at the DOCOMO Online Shop for a “New Online Shop Contract” ("New Online Shop Contract," which shall have the same meaning as a “New Online Shop Contract” provided in the “Online Shop Terms,” which are the terms and conditions applicable to your use of the DOCOMO Online Shop) set forth in the Internet Sales Terms (“Online Shop Terms”) separately provided by DOCOMO, and if you apply for a Carrier-Free d ACCOUNT in the said application procedure, wishing to use such account as a DOCOMO d ACCOUNT pursuant to Article 10.1 (,which shall refer to the provisions after the deemed replacement pursuant to Article 10.4, and the same shall apply hereinafter in this Article 4.9) after the conclusion of the New Online Shop Contract, you shall perform d POINT User Information Registration during the application procedure for the New Online Shop Contract in addition to joining the d POINT Club pursuant to Article 4.2 after completing the application for the Carrier-Free d ACCOUNT. Upon conclusion of the New Online Shop Contract pursuant to the Online Shop Terms and completion of the d-POINT Information Registration, the Carrier-Free d ACCOUNT you have newly applied for pursuant to this Article 4.9 will be converted to a DOCOMO d ACCOUNT associated with the New Online Shop Contract pursuant to Article 10.1. In this case, if the Line User ("Line User," who is a person whose name has been reported to DOCOMO by the Line Subscriber as a customer who actually uses the line associated with the Line Subscription Contract in the manner specified by DOCOMO pursuant to the contract agreement) has been reported to DOCOMO pursuant to the contract agreement regarding the subscription line associated with the New Online Shop Contract (“Online Shop New Subscription Line”), the information on the Line User will be registered as d-POINT User Information (this information shall be as separately specified by DOCOMO). If there is no report on the Line User, the same information as that of the subscriber of the New Online Shop Subscription Line will be registered as d-POINT User Information. If this causes any difference between the information registered on the DOCOMO d ACCOUNT and the d-POINT User Information, the registered information for the DOCOMO d ACCOUNT will change to the d-POINT User Information.

Article 5 Use of Biometrics Authentication by d ACCOUNT

  1. If you have a terminal equipped with any biometric authentication function separately specified by DOCOMO that uses your biometric information or screen unlock information (“Biometric Authentication-Compatible Terminal”), you may use such authentication function (“Biometric Authentication Function”) that requires you to enter your pre-registered biometric information (“Biometric Information”) or screen unlock information (“Screen Unlock Information”) in place of your d ACCOUNT ID/Password and network PIN (collectively "Biometric Authentication-Compatible Passwords; note that the network PIN shall be used only when the d ACCOUNT Setting associated with the DOCOMO d ACCOUNT is being used) for performing authentication on applications, sites, or services separately specified by DOCOMO (collectively “Biometric Authentication-Compatible Services”) to the extent separately specified by DOCOMO. If you wish to use the Biometric Authentication Function, you shall make sure that the Biometric Information or the Screen Unlock Information” is properly set in the Biometric Authentication-Compatible Terminal in advance pursuant to the procedures separately provided by DOCOMO. You shall read the notices shown on the screen while performing such settings. As such notices also constitute part of the Terms, you shall have an obligation to observe the notices.
  2. Biometric Information available for the Biometric Authentication Function includes fingerprints, irises, and faces. Biometric Information that you may use varies among Biometric Authentication-Compatible Terminals. Screen Unlock Information available for the Biometric Authentication Function includes PINs, passwords, and patterns. Screen Unlock Information that you may use varies among Biometric Authentication-Compatible Terminals and their OS.
  3. If you have entered Biometric Information or Screen Unlock Information on a Biometric Authentication-Compatible Terminal in a Biometric Authentication-Compatible Service, DOCOMO may deem that you have entered Biometric Authentication-Compatible Passwords.
  4. If you have changed the ID/Password of your d ACCOUNT, which is part of your Biometrics Authentication-Compatible Passwords, you shall perform re-authentication or re-registration by using your new ID/password of the d ACCOUNT before you use the Biometrics Authentication Function.
  5. If you have changed any Biometric Authentication-Compatible Passwords other than the ID/Password of your d ACCOUNT, you may continue to use the Biometric Authentication Function without re-authentication or re-registration. In this case, if you have entered the Biometric Information or Registered Screen Unlock Information in a Biometric Authentication-Compatible Service, DOCOMO may deem that you have entered your new Biometric Authentication-Compatible Passwords after the change.
  6. Regarding Biometric Authentication-Compatible Passwords other than the d ACCOUNT ID/Password, the use of the Biometric Authentication Function will not be restricted even if the use of such Biometric Authentication-Compatible Passwords is temporarily suspended.
  7. If you fail in the verification of Biometric Information a specified number of times, you will be locked out from using the Biometric Authentication Function. To unlock the Biometric Authentication Function based on Biometric information, you shall perform the Registered Screen Unlock Information set in the Biometric Authentication-Compatible Terminal. Note that the number of times you are allowed to make unsuccessful authentication attempts before being locked out from using the Biometric Authentication Function based on Biometric Information varies among Biometric Authentication-Compatible Terminals. If you fail to verify the Screen Unlock Information a specified number of times, your use of the Biometric Authentication Function based on Biometric Information will be restricted for a certain period of time. The period of restriction varies among Biometric Authentication-Compatible Terminals.
  8. DOCOMO makes no guarantees regarding the accuracy of biometric verification for matching of the Biometric Information based on the Biometric Authentication Function with Biometric Information you enter. Even if any Biometric Information is determined by the Authentication Function as a match to that of a third party, DOCOMO will deem such third party’s Biometric Information to be the Biometric Information and proceed with authentication, in which case Articles 5.3 and 5.5 shall apply. If the Screen Unlock Information is entered into the Biometric Authentication-Compatible Terminal, and even if it was entered by a third party, it will be deemed by DOCOMO to have been entered by you, in which case Articles 5.3 and 5.5 shall apply. In registering the Screen Unlock Information, you shall avoid any information that can be easily guessed by a third party (it is recommended that you use a PIN of 6 or more digits, a password of 8 or more alphanumeric characters, and a pattern that does not look familiar like an alphabetic character).
  9. If you decide to discontinue the use of the Biometrics Authentication Function, you shall deactivate its setting in accordance with the procedures separately provided by DOCOMO.
  10. DOCOMO may discontinue your use of the Biometric Authentication Function in the event of any of the following circumstances.
    1. You have breached any of the Terms.
    2. You have breached any of the software license agreements related to the Biometric Authentication Function.
    3. Your Biometric Authentication-Compatible Password has expired.
    4. DOCOMO determines that an unauthorized use of the Biometric Authentication Function has occurred or is likely to occur.
    5. You have taken any action deemed inappropriate by DOCOMO.
    6. Any other cases where DOCOMO considers it necessary to discontinue the use of the Biometrics Authentication Function

Article 6 Use of DOCOMO Application Manager

  1. You may use the following functions on a terminal if (i) the "DOCOMO Application Manager" (the "dAM") separately specified by DOCOMO is installed in the terminal, (ii) the terminal supports d ACCOUNT Setting, and (iii) the d ACCOUNT Setting is configured in the terminal (such terminal is a "Specified Terminal") regarding the applications supporting dAM ("dAM-Compliant Applications" including the dAM). Note that the functions specified in Articles 6.1 and 6.2 are only available for Customers who use DOCOMO d ACCOUNTs and are subscribed to the sp-mode, the ahamo internet connection service, the irumo internet connection service, or the DOCOMO mini internet service in the Line Subscription Contract.
    1. A function for automatic installation and update of specific dAM Compatible Applications (“Specific dAM-Compatible Applications”) necessary to use a service separately specified by DOCOMO ("dAM Subscribed Service Batch Installation- Compliant Service”) at the timing specified by DOCOMO upon the first activation of the Specified Terminal when you subscribe to the dAM Subscribed Service Batch Installation-Compliant Service (including a time when you conclude a new contract for sp mode, ahamo internet connection service, irumo internet connection service, or DOCOMO mini internet connection service if you are already subscribed to the dAM Subscribed Service Batch Installation Service) or at the first activation of the Specified Terminal after it is initialized.
    2. A function for easy installation and update of Specific dAM-Compatible Applications associated with the dAM Subscribed Service Batch Installation- Compliant Service to which you are subscribed on the screen designated by DOCOMO (such screen is displayed at the first activation of the Specified Terminal or the first activation of the said Terminal after it is initialized) (If you do not install or update Specific dAM-Compatible Applications on the said screen during initial setup, Specific dAM-Compatible Applications will be automatically installed or updated at the time specified by DOCOMO by the function specified in Article 6.1.1.).
    3. A function for installation and update of dAM-Compatible Applications
    4. A function to automatically check information on any available updates of the dAM-Compatible Applications installed on the Specified Terminal, send such update information to the notification area on the Specified Terminal, and display such information on the screen for a list of updates.
    5. A function to display a history of installed dAM-Compatible Applications saved on DOCOMO servers on the confirmation screen designated by DOCOMO and enable easy installation of such dAM-Compatible Applications from the confirmation screen (note that the range of installation history displayed shall be as separately determined by DOCOMO. The installation history of the Specified Terminal you use is sometimes displayed on a Specified Terminal that has the said setting for the same DOCOMO d ACCOUNT (including a DOCOMO d ACCOUNT that has been automatically converted to a Carrier-Free d ACCOUNT due to cancellation or transfer of the Line Subscription Contract as specified in Article 9.1) in the d ACCOUNT Setting or on a terminal using a subscription line of the Line Subscription Contract associated with the DOCOMO d ACCOUNT that has been converted from a Carrier-Free d ACCOUNT as a result of application pursuant to Article 10.1).
    6. A function for automatic update of any dAM-Compatible Applications deemed appropriate to be updated by DOCOMO at each timing determined by DOCOMO.
  2. Use of the dAM will incur communication charges, except for some cases.
  3. If you use any functions set forth in Article 6.1.4, information on all applications installed on the Specified Terminal (including applications other than dAM-Compatible Applications) will be sent to DOCOMO. DOCOMO will not use such information for any other purposes than the provision of the applicable functions.
  4. If you have installed the DOCOMO Speed Test Application separately provided by DOCOMO (such application is called “DST App” or by any name adopted if DOCOMO changes its name) on a Specified Terminal, and if you use the functions related to installation or update of dAM-Compatible Applications pursuant to Article 6.1, the dAM sometimes notifies the DST App of the download start time/date and end time/date of dAM-Compatible Applications (in a format that does not identify individual Customers or terminals). The DST App sometimes measures communication speeds at the location of the Specified Terminal using the information received from the dAM with an aim to allow DOCOMO to improve the quality of communication areas and to make area expansion plans. Details of the functions and setting change methods of the DST App and other specifications of the DST App shall be as determined separately by DOCOMO.

Article 7 d Account ID/Password Management

  1. You shall keep the ID/Password of your d ACCOUNT confidential so that they will not be known to any third party. You shall take full responsibility for the management and use of the terminals on which authentication using the ID/Password of your d ACCOUNT and your d ACCOUNT has been performed (“User Terminals," which include, but not limited to the terminals on which the d ACCOUNT Setting is configured). DOCOMO shall have no liability for any loss or damages you may suffer due to any insufficient management of the d ACCOUNT ID/Password, or the User Terminal, errors in use, or unauthorized use thereof by a third party, except for cases arising out of intentional acts or negligence on the part of DOCOMO.
  2. In setting your d ACCOUNT ID/Password, you shall avoid using any information that can be easily guessed by a third party, such as date of birth, address, and phone number.)
  3. You may change the d ACCOUNT ID/Password, Biometric Information and Screen Unlock Information in accordance with the procedures separately provided by DOCOMO. DOCOMO may reject your application if you fall under any of the circumstances set forth in Article 4.8.
  4. You shall register your contact email address to receive notifications about the d ACCOUNT ID and other information, while you may also register your contact mobile phone number. When applying for a Carrier-Free d ACCOUNT pursuant to Article 4.1, you shall register your contact mobile phone number upon DOCOMO’s request (such contact email addresses and mobile phone numbers you register or delete are subject to conditions separately provided by DOCOMO). If you are using a DOCOMO d ACCOUNT and wish to switch your Line Subscription Contract to Course B or cancel the Line Subscription Contract (only if you use DOCOMO mail carryover service ("DOCOMO Mail Carryover") provided pursuant to “DOCOMO mail carryover service terms of use” separately provided by DOCOMO after the switching or termination of the Line Subscription Contract), the contact email address is sometimes automatically registered without any action on your part (in which cases the contact email address is automatically registered shall be as separately specified by DOCOMO).
  5. If you wish to delete the contact mobile phone number registered with your Carrier-Free d ACCOUNT, you shall follow the procedures separately specified by DOCOMO, and you may not delete it yourself. In addition, you may not change the contact mobile phone number registered with your Carrier-Free d ACCOUNT unless otherwise specified by DOCOMO.
  6. You may reissue your d ACCOUNT password and confirm your issued d ACCOUNT ID by receiving an email or short message sent by DOCOMO at your registered contact email address or mobile phone number in Japan (if neither is registered, at the e-mail address or mobile phone number of the Line Subscription Contract associated with the d ACCOUNT) in accordance with the procedures separately provided by DOCOMO.
  7. If the email address registered as the contact email address or the mobile phone number in Japan registered as the contact mobile phone number is no longer under your control, you shall immediately change it to another usable email address or mobile phone number under your control. DOCOMO may delete the mobile phone number you have registered as a contact phone number without notice to you in cases separately determined by DOCOMO, such as when there is a request to delete the registration from the person whose name is on the Line Subscription Contract associated with the mobile phone number you have registered as a contact phone number. In this case, you shall register another usable mobile phone number under your control.
  8. If you use a d ACCOUNT (except for the d ACCOUNTs specified below), you may set your DOCOMO mail address as the ID of the d ACCOUNT. In order to use your DOCOMO mail address as your d ACCOUNT ID, you shall set the DOCOMO mail address as your contact mail address.
    1. DOCOMO d ACCOUNT (only if the sp-mode, i-mode, or DOCOMO Mail Option Service offered pursuant to the "Docomo Mail Option Terms of Use" separately provided by DOCOMO ("DOCOMO Mail Option") is not used with the DOCOMO d ACCOUNT.)
    2. DOCOMO d ACCOUNT (Course B) (only if the DOCOMO Mail Carryover is not used with the DOCOMO d ACCOUNT (Course B))
    3. Carrier-Free d ACCOUNT (only if the DOCOMO Mail Carryover is not used with the Carrier-Free d ACCOUNT)
    4. DOCOMO d ACCOUNT issued to a Customer who selects and applies for any of the following billing types (collectively “home 5G plans”) and at the same time applies for a DOCOMO d ACCOUNT associated with the home 5G Plan ("DOCOMO d ACCOUNT (home 5G Plans)").
      1. Course A among the categories pertaining to 5G contracts stipulated in the 5G service contract agreement (limited to the billing types specified in the provision terms and conditions "Billing Plan (home 5G Plan)" separately provided by DOCOMO)
      2. Any billing type related to those stipulated in the provision terms and conditions "Billing Plan (5G home Denwa)" separately provided by DOCOMO among the categories pertaining to 5G home Denwa contracts stipulated in the 5G service contract agreement.
      3. Any billing types related to those stipulated in the “Terms of Use of the Chikaku Service” separately provided by DOCOMO among the categories pertaining to general contracts stipulated in the Xi Service Contract Agreement.

      4. In addition, if you are using DOCOMO mail address as your DOCOMO d ACCOUNT ID, and if you change the DOCOMO email address, the ID and the contact mail address of the DOCOMO d ACCOUNT will be automatically changed to your new DOCOMO email address as of the date of such change. Note that if you are using your DOCOMO mail address as your DOCOMO d ACCOUNT ID, you may continue to use the character string of the DOCOMO mail address as the ID of your DOCOMO d ACCOUNT (this shall mean the ID of a Carrier-Free d ACCOUNT converted from the DOCOMO d ACCOUNT pursuant to Article 9 if the Line Subscription Contract is canceled) in any of the following cases: (i) you change your Line Subscription Contract to Course B (only if you do not use the DOCOMO Mail Carryover with your DOCOMO d ACCOUNT (Course B) associated with the Course B contract), (ii) you cancel the sp-mode contract, i-mode contract, or DOCOMO Mail Option associated with the Line Subscription Contract, (iii) you cancel the contract for the use of the DOCOMO Mail Carryover, or (iv) you cancel the Line Subscription Contract, provided that the contact email address will be automatically deleted upon completion of such change procedure regarding the Line Subscription Contract.
  9. If you are using a DOCOMO d ACCOUNT and forget your DOCOMO d ACCOUNT ID/password, you may apply for ID/password reissuance by following the procedures separately provided by DOCOMO. DOCOMO will process such reissuance applications in accordance with Article 3.5.
  10. If you are using a Carrier-Free d ACCOUNT and forget your Carrier-Free d ACCOUNT password, you may apply for password reissuance by following the procedure separately provided by DOCOMO. If the use of your Carrier-Free d ACCOUNT is suspended pursuant to Article 13.2, you may resume the use of such Carrier-Free d ACCOUNT by performing the procedure for password reissuance for the Carrier-Free d ACCOUNT.
  11. If you are using an Eligible Carrier-Free d ACCOUNT and forget the ID or password of the Eligible Carrier-Free d ACCOUNT (only if it is impossible to verify your identity in the method separately specified by DOCOMO and use your contact email address and contact mobile phone number or only if you forget your password and it is impossible to use your contact email address and contact mobile phone number), you may apply for ID/Password reissuance in accordance with the procedures separately provided by DOCOMO. DOCOMO will process such reissuance applications in accordance with Article 4.8.
  12. If your d ACCOUNT ID/password is lost or stolen, if your d ACCOUNT ID/password is known to a third party, or if it is found that your d ACCOUNT ID/password, Biometric Information, or Screen Unlock Information has been used by a third party, you shall take appropriate measures to prevent your d ACCOUNT ID/Password, Biometric Information, or Screen Unlock Information from being used by a third party, such as immediately changing your d ACCOUNT ID/Password or invalidating your d ACCOUNT Setting.

Article 8 Prohibited Acts

You shall not engage in any of the following acts in connection with the entry of the ID/Password, the use of the Biometric Authentication Function, or any other authentication using d ACCOUNTs:

  1. Acts that perform illegal authentication using d ACCOUNTs such as unauthorized entry of the ID/Password and use of the Biometric Authentication Function.
  2. Acts that disclose, rent, transfer, sell, or pledge the d ACCOUNT ID/password or other information related to authentication using d ACCOUNTs to a third party or allow a third party to use any of such information.
  3. Acts that allow a third party to use the Biometric Authentication Function.
  4. Acts that enter the d ACCOUNT ID/Password, use the Biometric Authentication Function, or use any other information related to authentication using d ACCOUNTs for any purposes other than performing authentication necessary for using Compliant Services.
  5. Acts that Infringe or damage the privacy or other rights, property, honor, or credit of a third party or DOCOMO.
  6. Acts that gain unauthorized access to or place an excessive burden on DOCOMO equipment.
  7. Acts that that pose a problem or are likely to pose a problem for Compliant Services or other DOCOMO services or DOCOMO’s business operations.
  8. Acts that interferes with or are likely to interfere with DOCOMO’s business activities.
  9. Acts that cause or are likely to cause disadvantage or damage to DOCOMO or a third party.
  10. Criminal acts or acts that lead to or are likely to lead to criminal acts.
  11. Acts of the same Customer to issue six or more Carrier-Free d ACCOUNTs, unless otherwise approved by DOCOMO.
  12. In addition to the acts set forth in the preceding paragraphs, any acts that violate or are likely to violate the Terms, the Line Subscription Contract, or any other contracts with DOCOMO, laws and regulations, or public policy.

Chapter 2 Conversion of d ACCOUNT

Article 9 Conversion of DOCOMO d ACCOUNT to Carrier-Free d ACCOUNT

  1. The DOCOMO d ACCOUNT that you own will be automatically converted to a Carrier-Free d ACCOUNT in the event of any of the following circumstances: (i) you have canceled your Line Subscription Contract, (ii) DOCOMO has terminated your Line Subscription Contract pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract, or (iii) your Line Subscription Contract has been transferred to another person. Provided that the item (iii) will not apply to the cases where the Transferee to whom the Line Subscription Contract is transferred is a Line User under the Line Subscription Contract applicable until the transfer (and such person shall be either a parent or a child of the person who concluded the Line Subscription Contract applicable until the transfer or any other person deemed to satisfy the conditions separately provided by DOCOMO).
  2. If your DOCOMO d ACCOUNT is automatically converted to a Carrier-Free d ACCOUNT pursuant to Article 9.1, the Customer information you registered when you applied for the DOCOMO d ACCOUNT will be carried over to the Carrier-Free d ACCOUNT as the registration information for the Carrier-Free d ACCOUNT.
  3. If your DOCOMO d ACCOUNT is converted to a Carrier-Free d ACCOUNT pursuant to Article 9.1, you may continue to use the Compliant Services separately designated by DOCOMO among those you used with your DOCOMO d ACCOUNT before the termination or transfer of the Line Subscription Contract pursuant to the conditions separately provided by DOCOMO for each Compliant Service, while retaining your usage information associated with the DOCOMO d ACCOUNT. You shall carefully check the usage conditions of Compliant Services you wish to use because such conditions sometimes differ between their usage with a DOCOMO d ACCOUNT and their usage with a Carrier-Free d ACCOUNT.
  4. You may continue to use certain Subscriber-Only Services only to the extent separately determined by DOCOMO with your Carrier-Free d ACCOUNT even if your DOCOMO d ACCOUNT has been converted to the Carrier-Free d ACCOUNT after you cancelled the Line Subscription Contract or DOCOMO terminated it pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract. In this case, only to the extent of the said use, the Carrier-Free d ACCOUNT will be deemed to be a DOCOMO d ACCOUNT, to which the provisions of the Terms will apply. Provided that this Article 9.4 will not apply to any other DOCOMO d ACCOUNT issued for the same Line Subscription Contract pursuant to Article 9.5.
  5. Even if you have canceled your Line Subscription Contract or DOCOMO has terminated it pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract, and even if you are no longer a Line Subscriber of such Line Subscription Contract (including a case where you had no DOCOMO d ACCOUNT issued to you when the Line Subscription was concluded), you may apply for and receive a DOCOMO d ACCOUNT from DOCOMO only for a period of 3 months including the month in which the Line Subscription Contract is terminated pursuant to the procedures separately provided by DOCOMO. Note that Article 3.6 shall apply mutatis mutandis to determine whether to accept or reject such applications made pursuant to this Article 9.5. However, you shall have no right to receive a DOCOMO d ACCOUNT pursuant to this Article 9.5 if your DOCOMO d ACCOUNT has been automatically converted to a Carrier-Free d ACCOUNT after you canceled your Line Subscription Contract or DOCOMO terminated it pursuant to the contract agreement due to your failure to pay bills or other debts associated with the Line Subscription Contract (see Article 9.4).
  6. Your DOCOMO d ACCOUNT issued through the application procedure set forth in Article 9.5 will be automatically converted to a Carrier-Free d ACCOUNT upon issuance, while the Customer information you register when you apply for the DOCOMO d ACCOUNT will not be carried over as the registration information for the Carrier-Free d ACCOUNT, unless otherwise specified by DOCOMO. Similarly, the usage information for any Compliant Services used with your DOCOMO d ACCOUNT before the termination of your Line Subscription Contract will not be carried over. Note that if you perform the procedure to reissue the DOCOMO d ACCOUNT issued through the application procedure provided in Article 9.5, the Carrier-Free d ACCOUNT received through automatic conversion will expire upon reissuance of the DOCOMO d ACCOUNT.
  7. If you have received a Carrier-Free d ACCOUNT through conversion as provided in Article 9.5, you may use certain Subscriber-Only Services with your Carrier-Free d ACCOUNT to the extent separately specified by DOCOMO. In this case, only to the extent of the said use, the Carrier-Free d ACCOUNT shall be deemed to be a DOCOMO d ACCOUNT, to which the provisions of the Terms shall apply.

Article 10 Conversion of Carrier-Free d ACCOUNT to DOCOMO d ACCOUNT

  1. If you are using a Carrier-Free d ACCOUNT, and if you have concluded a Line Subscription Contract in your name (except for contracts concluded under the name of a corporation), you may apply for the conversion of the Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT by performing the procedure to add the telephone number associated with the subscription line to the registration information for the Carrier-Free d ACCOUNT as designated by DOCOMO (the "Phone Number Registration"). Upon completion of the Phone Number Registration, your Carrier-Free d ACCOUNT will be converted to a DOCOMO d ACCOUNT. In this case, the Customer information you registered during your application of the Carrier-Free d ACCOUNT will be carried over as the registration information for the DOCOMO d ACCOUNT. Regarding the Carrier-Free d ACCOUNT you specified to use as a DOCOMO d ACCOUNT (Course B) in the contract application procedure for Course B (including a Carrier-Free d ACCOUNT issued through your application for a new Carrier-Free d ACCOUNT in the contract application procedure for Course B pursuant to Article 4.3), the Phone Number Registration will be automatically completed upon conclusion of the Course B contract associated with the said contract application, and the Carrier-Free d ACCOUNT will be converted to a DOCOMO d ACCOUNT.
  2. If you have completed the Phone Number Registration pursuant to Article 10.1 (except for Course B Line Subscribers), and if you have used Compliant Services based on the authentication using the Carrier-Free d ACCOUNT performed before the Phone Number Registration, you may continue to use some of those Compliant Services as separately designated by DOCOMO in accordance with the conditions separately provided by DOCOMO for each Compliant Service by performing authentication using the DOCOMO d ACCOUNT or the subscription line of the Line Subscription Contract, while retaining your usage information registered before the Phone Number Registration. It shall be noted that if your use of Compliant Services before the completion of the Phone Number Registration was based on a method of authentication that authenticates the subscription line of the Line Subscription Contract, the usage information and points related to such use will be deleted and cannot be restored (the d POINTs specified in Article 14 will not be deleted). In addition, if you wish to use Compliant Services pursuant to this Article 10.2, you shall carefully check the usage condition of each Compliant Service in advance because the usage condition of Compliant Services is sometimes different between before and after the completion of the Phone Number Registration.
  3. If you are using your Carrier-Free d ACCOUNT as a DOCOMO d ACCOUNT (Course B) pursuant to Article 10.1, and if you have not joined the d PONT Club and/or performed d Point User Information Registration at the time of applying for the Course B contract, you shall simultaneously join the d POINT Club (only if you have withdrawn from the d POINT Club at the time of applying for the Course B contract) and perform your d POINT User Information Registration (only if you have not registered your d-Point User Information at the time of applying for the Course B contract) at the time of applying for the Course B contract. Upon completion of your Course B contract application procedure, you shall be deemed by DOCOMO to have completed your application for the d POINT Club and your d POINT User Information Registration.
  4. If you apply for a New Online Shop Contract, the provisions of Articles 10.1 and 10.3 shall apply with the replacement of terms as follows.
    1. Article10.1
      If you are using a Carrier-Free d ACCOUNT, and if you have concluded a Line Subscription Contract in your name (except for contracts concluded under the name of a corporation), you may apply for the conversion of your Carrier-Free d ACCOUNT to a DOCOMO d ACCOUNT by completing the procedure to add the telephone number of the subscription line to the registration information for the Carrier-Free d ACCOUNT as designated by DOCOMO (the "Phone Number Registration"). Upon completion of the Phone Number Registration, your Carrier- Free d ACCOUNT will be converted to a DOCOMO d ACCOUNT. In this case, the Customer information you registered when you applied for the Carrier-Free d ACCOUNT will be carried over as the registration information for the DOCOMO d ACCOUNT. Regarding the Carrier-Free d ACCOUNT you specified to use as a DOCOMO d ACCOUNT in the application procedure for a New Online Shop Contract (including a Carrier-Free d ACCOUNT issued through your application for a new Carrier-Free d ACCOUNT in the application procedure for the New Online Shop Contract pursuant to Article 4.9), the Phone Number Registration will be automatically completed upon conclusion of such New Online Shop Contract, and the Carrier-Free d ACCOUNT will be converted to a DOCOMO d ACCOUNT.
    2. Article 10.3
      If you are using your Carrier-Free d ACCOUNT as a DOCOMO d ACCOUNT pursuant to Article 10.1, and you have not joined the d PONT Club and/or performed d Point User Information Registration at the time of applying for a New Online Shop Contract, you shall join the d POINT Club (only if you have withdrawn from the d POINT Club at the time of applying for the New Online Shop Contract) and perform your d POINT User Information Registration (only if you have not registered your d-Point User Information at the time of applying for the New Online Shop Contract) at the time of applying for the New Online Shop Contract pursuant to the Online Shop Terms. Upon completion of your New Online Shop Contract application procedure, you shall be deemed by DOCOMO to have completed your application for the d POINT Club and your d POINT User Information Registration. In addition, if you wish to perform the Phone Number Registration to the Online Shop New Subscription Line with regard to the Carrier-Free d ACCOUNT, and if the Line User has been reported to DOCOMO regarding the New Online Shop Subscription Line pursuant to the contract agreement of such line, the same information as the information on the Line User will be registered as the d Point User Information (it shall mean the information separately specified by DOCOMO), and if the Line User has not been reported, the same information as the information on the Line Subscriber of the New Online Shop Subscription Line will be registered as the d POINT User Information. If you find that the information registered as the Carrier-Free d ACCOUNT Application Information or the d-POINT User Information is different from the information of the Line User, you may change the Carrier-Free d ACCOUNT Application Information or the d-POINT User Information to the Line User information when applying for a Now Online Shop Contract (note that if the name, date of birth, or address is not registered in the Carrier-Free d ACCOUNT Application Information or the d-PONT User Information, such Carrier-Free d ACCOUNT Application Information or d POINT User Information will be automatically changed to the information of the Line User of the New Online Shop Subscription Line upon completion of the contract application procedure).
  5. If you are using your Carrier-Free d ACCOUNT as a DOCOMO d ACCOUNT pursuant to Article 10.1, and if you have not joined the d PONT Club and/or performed d Point User Information Registration at the time of applying for “Online Shop Model Change” or “Online Shop Subscription Change” (, which shall have the same meaning as the “Online Shop Model Change” and “Online Shop Subscription Change” specified in the Online Shop Terms, respectively, and collectively “Online Shop Model Changes"), you shall join the d POINT Club (only if you have withdrawn from the d POINT Club at the time of applying for the Online Phone Model Changes) and perform your d POINT User Information Registration (only if you have not registered your d POINT User Information at the time of applying for the Online Shop Model Changes) at the time of applying for the Online Shop Model Changes pursuant to the Online Shop Terms. Upon completion of your application procedure for the Online Shop Model Changes, you shall be deemed by DOCOMO to have completed your application for the d POINT Club and your d POINT User Information Registration. In this case, if the Line Subscriber of the subscription line associated with the Online Shop Model Changes (the "Online Shop Model Change Line") and the person who has been reported to DOCOMO as the Line User pursuant to the contract agreement for the line are the same person, the same information as the Line Subscriber information will be registered as the d POINT User Information (,which shall be as separately specified by DOCOMO). If the Line Subscriber and the Line User are the same person, and if information different from that of the Line Subscriber is registered as the DOCOMO d ACCOUNT information or d-point User information, you may change the information of the DOCOMO d ACCOUNT or the d-point User to the information of the Line Subscriber (note that if the name, date of birth, or address is not registered in the DOCOMO d ACCOUNT Information or the d-PONT User Information, such information will be automatically changed to the information of the Line Subscriber of the Online Shop Model Change Line upon completion of the contract application procedure).

Chapter 3 Termination of d ACCOUNT

Article 11 Termination of DOCOMO d ACCOUNT

  1. If you wish to discontinue the use of your DOCOMO Line-d Account (except when you are using a DOCOMO d ACCOUNT (Course B) or DOCOMO d ACCOUNT (Home5G, etc.)), you shall apply for the termination procedure pursuant to the procedures separately provided by DOCOMO. Upon approval of such application by DOCOMO, your DOCOMO d ACCOUNT shall cease to be effective.
  2. If DOCOMO terminates your Line Subscription Contract pursuant to the contract agreement on the ground that it is found that you made a false statement in a document specified by DOCOMO when applying for the Line Subscription Contract or that you reported an untrue statement regarding modifications of provisions of the contract agreement, your DOCOMO d ACCOUNT shall automatically cease to be effective.
  3. DOCOMO may terminate your DOCOMO d ACCOUNT in the event of any of the following circumstances.
    1. You have breached any of the Terms.
    2. You have taken any other action deemed inappropriate by DOCOMO.
  4. DOCOMO shall have no liability for any damages you may suffer due to any termination of DOCOMO d ACCOUNTs pursuant to this Article.

Article 12 Termination of Carrier-Free d ACCOUNT

  1. If you wish to discontinue the use of your Carrier-Free d ACCOUNT, you shall terminate your Carrier-Free d ACCOUNT. You may terminate your Carrier-Free d ACCOUNT after performing authentication using your Carrier-Free d ACCOUNT on the dedicated site pursuant to the procedures separately specified by DOCOMO. You shall read the following cautions carefully before terminating your Carrier-Free d ACCOUNT.
    • If your Carrier-Free d ACCOUNT is terminated, you may not continue to use the Compliant Services you are using with your Carrier-Free d ACCOUNT.
    • Even if your Carrier-Free d ACCOUNT ceases to be effective, it does not automatically delete your membership or subscription in the Compliant Services you are using with your Carrier-Free d ACCOUNT, except for those specified separately by DOCOMO. In addition, if you have terminated your Carrier-Free d ACCOUNT before you cancel your membership or subscription of the Compliant Services you are using, it will become impossible for you to terminate your membership or subscription in such Compliant Services. You shall therefore be sure to perform the procedure to terminate the membership or subscription of each such Compliant Service before terminating your Carrier-Free d ACCOUNT. In particular, you shall be careful if you are using Compliant Services that continuously generate usage fees.
  2. Notwithstanding the foregoing, you may not terminate your Carrier-Free d ACCOUNT you are using if any of the following apply to the Carrier-Free d ACCOUNT, except for the cases specified in each of the following.
    1. Carrier-Free d ACCOUNT you requested with an intention to use it as a DOCOMO d ACCOUNT (Course B) in the course B contract application procedure (including a Carrier-Free d ACCOUNT issued based on an application for a new Carrier-Free d ACCOUNT in the course B contract application procedure pursuant to Article 4.3): In the case where DOCOMO does not accept the Course B subscription application.
    2. Carrier-Free d ACCOUNT you requested with an intention to use it as a DOCOMO d ACCOUNT in the Online Shop New Contract application procedure (including a Carrier-Free d ACCOUNT issued based on an application for a new Carrier-Free d ACCOUNT in the New Online Shop Contract application procedure pursuant to Article 4.9): In the case where DOCOMO does not accept the New Online Shop Contract application.
  3. DOCOMO may terminate your DOCOMO Carrier-Free d ACCOUNT in the event of any of the following circumstances.
    1. You have breached any of the Terms.
    2. The use of the Carrier-Free d ACCOUNT is not yet restarted even after a considerable period of time has passed since the measures for suspension of use were taken pursuant to Article 13.2.3.
    3. You have a Carrier-Free d ACCOUNT issued through automatic conversion, and you still fail to pay the debts related to the Line Subscription Contract you concluded in the past (including installment payments for mobile terminal charges) even after their due date has passed (including cases where DOCOMO has transferred the debts to NTT Finance Corporation, and you have made no payments to the said company).
    4. You have taken any other action deemed inappropriate by DOCOMO.
  4. DOCOMO shall have no liability for any damages you may suffer due to any termination of Carrier-Free d ACCOUNTs pursuant to this Article.

Article 13 Suspension and discontinuation of d ACCOUNT

  1. You are not sometimes permitted to use your DOCOMO d ACCOUNT if you fail to pay the debts related to the Line Subscription Contract (including installment payments for mobile terminal charges) even after the due date has passed (including cases where DOCOMO has transferred the debts to NTT Finance Corporation, and you have made no payments to the said company).
  2. If any of the following apply to the d ACCOUNT you are using, DOCOMO may temporarily suspend your use of d ACCOUNT or take other measures. In this case, if you wish to resume the use of your d ACCOUNT, you shall apply for the reactivation of your d ACCOUNT pursuant to the procedures separately provided by DOCOMO. However, with regard to Articles 13.2.2, 13.2.4, and 13.2.5, DOCOMO will not accept your request to reactivate your d ACCOUNT if DOCOMO cannot determine that any of the circumstances described in the items stated above have been resolved. If your d ACCOUNT is reactivated against DOCOMO's will, DOCOMO may cancel such reactivation.
    1. Incorrect d ACCOUNT password, security code, or other similar information has been entered more than a certain number of times.
    2. DOCOMO determines that there is or may be an unauthorized login.
    3. DOCOMO cannot confirm the use of your Carrier-Free d ACCOUNT for a certain period of time.
    4. You are engaged in an act that falls under Article 8.11.
    5. DOCOMO otherwise determines that it is necessary to suspend your use of d ACCOUNT.
  3. DOCOMO may suspend your use of d Account or the Biometric Authentication Function due to system maintenance or failure. In this case, except in emergency situations, DOCOMO will inform you of such suspension in advance.
  4. DOCOMO shall have no liability for any damages you may suffer due to any discontinuation or suspension of the use of d ACCOUNTs or the Biometric Authentication Function pursuant to this Article.

Chapter 4 Miscellaneous Provisions

Article 14 d POINTs

  1. You may withdraw only from the d-POINT Club you joined when you applied for a Carrier-Free d ACCOUNT pursuant to Article 4.2 by following the procedures separately provided by DOCOMO after obtaining a d ACCOUNT.
  2. Notwithstanding the foregoing, you may not withdraw from the d-POINT Club if any of the following apply to your Carrier-Free d ACCOUNT, except for the cases specified in each of the following.
    1. Carrier-Free d ACCOUNT you requested with an intention to use it as a DOCOMO d ACCOUNT (Course B) in the course B contract application procedure (including a Carrier-Free d ACCOUNT issued based on an application for a new Carrier-Free d ACCOUNT in the course B contract application procedure pursuant to Article 4.3): In the case where DOCOMO does not accept the Course B subscription application.
    2. You specified the Carrier-Free d ACCOUNT to use it as a DOCOMO d ACCOUNT in the New Online Shop Contract application procedure (including a Carrier-Free d ACCOUNT issued based on an application for a new Carrier-Free d ACCOUNT in the New Online Shop Contract application procedure pursuant to Article 4.9): In the case where DOCOMO does not accept the New Online Shop Contract application, or DOCOMO accepts the New Online Shop Contract application and the Online Shop New Subscription Line is available for use.
  3. If your DOCOMO d ACCOUNT is terminated for any of the reasons specified in Articles 11.1 and 11.3 while it retains the Line Subscription Contract, your membership of the d-POINT Club will continue. However, if your Carrier-Free d ACCOUNT is terminated for any of the reasons specified in Article 12, your membership of the d POINT Club will be terminated, and you shall withdraw from the d POINT Club.
  4. For the conditions to use the programs for DOCOMO points called "d POINTs" provided in the d POINT Club, you shall refer to the d POINT Club Membership Rules.

Article 15 Exclusion of Anti-Social Forces

  1. You represent and warrant that you do not, and will not in future, fall under any of the following categories:
    1. You are an organized crime group (boryokudan), a member of an organized crime group (boryokudan-in), a person who was a member of an organized crime group (boryokudan-in) within the past 5 years, a quasi-member of an organized crime group (boryokudan jun kosei-in), a corporation related to an organized crime group (boryokudan kankei kigyo), a corporate racketeer (Sokaiya), a person engaging in criminal activities under the name of social campaigns (shakai undo tou hyobo goro) or an organized crime group specialized in intellectual crimes (tokushu chino boryoku shudan), or any other person similar to any of the above (collectively “Anti-Social Forces”).
    2. You have a relationship in which you are deemed to use an Anti-Social Force to engage in transactions intended to obtain unfair profits for you or a third party or cause harm to a third party.
    3. You have a relationship in which you are deemed to provide funds or benefits to an Anti-Social Force or otherwise to be involved with an Anti-Social Force.
  2. You warrant that you will not engage in any of the following conducts by yourself or by using a third party:
    1. Conduct of making a violent demand
    2. Conduct of making an unjust demand beyond legal responsibility
    3. Conduct of using intimidation or violence in a transaction
    4. Conduct of discrediting DOCOMO or disrupting operations of DOCOMO by spreading false information or using fraudulent means or force
    5. Any other conduct similar to any of the above.

Article 16 No Assignment

You may not assign, delegate, lend, or encumber to a third party all or any part of your obligations under the Terms.

Article 17 Processing of your personal data

DOCOMO separately publishes information on how DOCOMO processes your personal data in the “NTT DOCOMO Privacy Policy.

Article 18 Application and modification of the Terms

  1. In any of the following circumstances, DOCOMO may modify any part of the Terms upon announcement or notification thereof to Customers using a method deemed appropriate by DOCOMO, and the modified version of the Terms shall become effective as of the effective date of the modification.
    1. Such modification to the Terms is in the general interest of Customers.
    2. Such modification to the Terms is not contrary to the purpose of contracts under the Terms and is reasonable in light of the necessity of the modification, the adequacy of the content after the modification, and other circumstances regarding the modification.

Article 19 Transmission of information

DOCOMO sometimes sends you information on d ACCOUNTs or Compliant Services using a method deemed appropriate by DOCOMO, such as sending an email to the email address you use as your d ACCOUNT ID, the email address you used as your d ACCOUNT ID, or your contact email address (including the contract email address you have specified as the “main contract email address” on the dedicated website (or the email address specified by DOCOMO as “the main contact email address” on the dedicated website if you have specified no such address), sending a short message to the mobile phone number associated with the Line Subscription Contract or the contact mobile phone number.

Article 20 Damages

  1. In the event that DOCOMO is liable to you for damages in connection with the entry of the d ACCOUNT ID/Password, the use of the Biometric Authentication Function, or any other authentication using d ACCOUNTs (including, but not limited to, failure to perform authentication using those d ACCOUNTs), such liability shall not exceed the amount equal to the lowest monthly basic charge of FOMA, Xi, or 5G, and DOCOMO shall not be liable for damages resulting from indirect damages, special damages, incidental damages, lost profits, or lost opportunities.
  2. The provisions of Article 20.1 shall not apply to cases arising out of intentional acts or negligence on the part of DOCOMO.

Article 21 Governing Law and Jurisdiction

  1. The conclusion, validity, performance, and construction of the Terms shall be governed by the laws of Japan.
  2. Any litigation that becomes necessary between you and DOCOMO in relation to the Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the local district court responsible for your place of residence in Japan as the first court of instance.

The Terms will take effect on September 20, 2006.

Supplementary Provisions (October 30, 2019)
The modified Terms will take effect on October 31, 2019.

Supplementary Provisions (March 24, 2020)
The modified Terms will take effect on March 25, 2020.

Supplementary Provisions (May 31, 2020)
The modified Terms will take effect on June 2, 2020.

Supplementary Provisions (June 15, 2020)

  1. The modified Terms will take effect on July 15, 2020.
  2. Regarding an Eligible Carrier-Free d ACCOUNT issued before the modified Terms take effect, if there is any difference between the d POINT User Information and the Carrier-Free d ACCOUNT Application Information at the time the modified Terms take effect, DOCOMO will apply Article 4.2 mutatis mutandis and change the Carrier-Free d ACCOUNT Application Information to the d POINT User Information, deeming that the d POINT User Information Registration has been performed based on the d POINT User Information at the time the modified Terms take effect.

 

Supplementary Provisions (December 1, 2020)
The modified Terms will take effect on December 9, 2020.

Supplementary Provisions (March 24, 2021)
The modified Terms will take effect on March 26, 2021.

Supplementary Provisions (May 11, 2021)

  1. The modified Terms will take effect on May 13, 2021.
  2. Any DOCOMO d ACCOUNTs already issued at the time the modified terms take effect in association with Line Subscription Contracts concluded in the name of a corporation pursuant to the Terms effective before the modified Terms take effect ("Corporate Line d ACCOUNTs") shall be included in DOCOMO d ACCOUNTs set forth in the modified Terms.
  3. I you have a Corporate Line d ACCOUNT, you may convert it to a Business d ACCOUNT through an application procedure separately provided by DOCOMO. DOCOMO will process your application in accordance with the provisions for the issuance of Business d ACCOUNTs set forth in the “terms and conditions of Business d ACCOUNT." Upon completion of the conversion procedure, the registration information and other details on your Corporate Line d ACCOUNT will be carried over to your Business d ACCOUNT created after the conversion. Note that you may no longer covert your Business d ACCOUNT to a DOCOMO d ACCOUNT once it has completed the above-mentioned conversion procedure.
  4. Upon completion of the procedure to convert a DOCOMO d ACCOUNT associated with a Corporate Line d ACCOUNT to a Business d ACCOUNT pursuant to the provisions of the preceding paragraph, the authentication status retained based on the d ACCOUNT's ID/Password as set forth in Article 1.9 of the modified Terms will become invalid.
  5. Notwithstanding the provisions of Article 7.8 of the modified Terms, if you have a Corporate Line d ACCOUNT and forget its ID/password, you will be asked to convert the Corporate Line d ACCOUNT to a Business d ACCOUNT and reissue the Business d ACCOUNT as set forth in the paragraph 3 of the Supplementary Provisions pursuant to the procedures separately provided by DOCOMO. In this case, DOCOMO will process the procedures in accordance with the provisions for the issuance of Business d ACCOUNTs set forth in the terms and conditions of Business d ACCOUNT. Upon completion of such application procedures, the registration information and other details on the Corporate Line d ACCOUNT will be carried over to the Business d ACCOUNT created after the said procedures.
